Terms and Conditions

1. Introduction and Definitions

These Terms and Conditions ("Terms") govern your access to and use of the website, platform, and services provided by HYRE UP PTY LTD (ABN 78 685 669 210, ACN 683 179 961) trading as MedHireHub ("we", "us", "our", or "MedHireHub").

By accessing our website, registering an account, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Definitions:

  • "Platform" means the MedHireHub website, mobile applications, and any related services
  • "Services" means the staffing and recruitment services provided by MedHireHub
  • "Worker" means a healthcare professional or support worker engaged by MedHireHub who delivers care and support services at a Client's location
  • "Client" means a healthcare facility, NDIS provider, aged care facility, home care provider, plan manager, or support coordinator that contracts with MedHireHub to receive staffing services. The Client is the organisation that pays MedHireHub for staffing services
  • "Client's Client" means the individual receiving care or support services from a Worker (for example, an NDIS participant, aged care resident, or home care recipient). Client's Clients are the responsibility of the Client provider, not MedHireHub
  • "User" means any person who accesses or uses our Platform, including Workers and Clients
  • "Placement" means the engagement of a Worker to perform shifts for a Client's Clients at a Client location
  • "Roster" means the schedule of shifts allocated to a Worker by MedHireHub based on Client requirements
  • "Shift" means an individual period of work performed by a Worker at a Client location, delivering care or support to the Client's Clients
  • "Provider Portal" means the secure online interface through which Clients may view rosters, shift notes, and worker credentials for shifts relating to their own Client's Clients

Relationship Structure: MedHireHub engages Workers as casual employees (or contractors) and allocates them to shifts at Client locations. The Client is the organisation that receives staffing services from MedHireHub. The Client's Clients are the individuals receiving care from the Worker. MedHireHub does not have a direct relationship with the Client's Clients and does not deliver care services directly to them.

Important: MedHireHub operates as a staffing agency engaging casual healthcare workers and connecting them with NDIS providers, aged care facilities, home care providers, plan managers, and support coordinators. We primarily engage workers on a casual basis. We are not a registered NDIS provider, aged care provider, or healthcare service provider. We do not deliver clinical care, disability support, or aged care services directly to individuals.

2. Nature of Services

MedHireHub operates as a healthcare staffing and recruitment agency. Our role is to:

  • Source, screen, and verify qualified healthcare workers
  • Onboard workers through account creation, profile setup, and document verification
  • Allocate rostered shifts to workers based on client needs and worker availability
  • Facilitate shift completion, including shift note recording and attendance confirmation
  • Facilitate communication between workers and clients
  • Provide administrative support for placements, including rostering assistance and credential verification
  • Process payroll for casual workers through our Intuit QuickBooks integration

Workers are primarily engaged as casual employees of HYRE UP PTY LTD. In limited circumstances, Workers may be engaged as independent contractors. There is no guarantee of constant or ongoing work. Shift allocation is based on client demand, worker availability, qualifications, and operational requirements.

We do not control the day-to-day clinical decisions, care plans, or workplace conditions at client facilities. Clients retain full responsibility for the supervision, direction, clinical oversight, and care provided at their locations. MedHireHub's role is limited to staffing allocation, credential verification, and payroll administration.

3. Eligibility and Registration

3.1 Workers

MedHireHub engages Workers primarily on a casual employment basis under the applicable Modern Award. In limited circumstances, Workers may be engaged as independent contractors with a valid ABN. Your engagement status will be confirmed in writing before you commence work.

Casual Employees (TFN):

  • MedHireHub is your employer. We deduct PAYG tax from your wages and pay it to the Australian Taxation Office on your behalf
  • MedHireHub pays superannuation guarantee contributions into your nominated super fund where required by law
  • MedHireHub covers you under our workers compensation insurance for work-related injuries
  • MedHireHub pays all applicable payroll taxes and employment-related charges
  • You receive casual loading in accordance with the applicable Modern Award
  • You must provide a Tax File Number (TFN) for payroll purposes

Independent Contractors (ABN):

  • You are self-employed, not an employee of MedHireHub
  • You must hold a valid ABN and issue valid tax invoices for services rendered
  • You are solely responsible for your own tax obligations, including income tax and GST (if registered)
  • You are solely responsible for your own superannuation contributions
  • You must maintain your own workers compensation, public liability, and professional indemnity insurance
  • You are not entitled to any employee benefits from MedHireHub, including casual loading, superannuation guarantee, paid leave, or workers compensation

To register as a Worker, you must:

  • Be at least 18 years of age
  • Hold valid and current qualifications relevant to the roles you seek
  • Hold all required registrations, licences, and clearances (including AHPRA registration where applicable, NDIS Worker Screening Check, and Working with Children Check)
  • Have the legal right to work in Australia
  • Provide accurate, complete, and truthful information in your profile and application
  • Upload all required documents to your profile, including qualifications, clearances, police checks, and other credentials requested by MedHireHub
  • Maintain appropriate insurances (including professional indemnity and public liability where required)

You must promptly update your profile and re-upload documents if any of your qualifications, registrations, clearances, or circumstances change. Providing false or misleading information, or failing to maintain current documents, may result in immediate termination of your account and exclusion from future placements.

Important: It is the Worker's sole responsibility to ensure all credentials, registrations, clearances, and qualifications remain current and valid at all times while engaged by MedHireHub and during all shifts. MedHireHub verifies credentials at onboarding and periodically thereafter, but the Worker bears ultimate responsibility for maintaining validity. If any credential expires or becomes invalid, the Worker must immediately notify MedHireHub and cease accepting shifts until the credential is renewed.

3.2 Clients

To register as a Client, you must:

  • Be a legally registered business, organisation, or entity
  • Hold all required licences, accreditations, and provider registrations (including NDIS provider registration or aged care approval where applicable)
  • Provide accurate and complete business information
  • Have authority to enter into binding agreements on behalf of the organisation

4. Worker Obligations

By using our Services, Workers agree to:

  • Maintain all qualifications, registrations, and clearances required for the roles they undertake, and ensure all documents remain current and uploaded to your profile
  • Complete all mandatory training and certifications required by MedHireHub, the client facility, or applicable law (including but not limited to NDIS Worker Orientation Module, infection control training, and manual handling training) before commencing work and maintain currency of such training
  • Notify MedHireHub immediately of any changes to your employment status, qualifications, registrations, clearances, or training certifications
  • Accept or decline rostered shifts in a timely manner through the Platform
  • Attend allocated shifts at the designated client location, arrive on time, and complete the full shift as rostered
  • Record accurate shift details, notes, and completion confirmations through the Platform as required
  • Behave in a professional, respectful, and appropriate manner at all times while at client locations. Workers are solely responsible for their own conduct, actions, and behaviour during shifts
  • Comply with the policies, procedures, and lawful directions of the client facility during placements
  • Provide services in a professional, competent, and ethical manner consistent with industry standards
  • Maintain confidentiality of all client, patient, participant, and resident information encountered during placements
  • Comply with the NDIS Code of Conduct when working at NDIS provider locations, including acting with respect for individual rights, promoting wellbeing, providing supports safely, and acting with integrity and honesty
  • Comply with the Aged Care Code of Conduct when working at aged care facilities, including acting with respect for individual dignity, promoting wellbeing, and providing quality care
  • Comply with child safety obligations, including maintaining a valid Working with Children Check and adhering to child-safe practices when working with children or in environments where children are present
  • Mandatory Reporting: Report any suspected or actual incidents of abuse, neglect, or exploitation of children, elderly persons, or persons with disability to:
    • The relevant state or territory child protection authority (for suspected child abuse or neglect)
    • The Aged Care Quality and Safety Commission (for reportable incidents in aged care under the Serious Incident Response Scheme)
    • The NDIS Quality and Safeguards Commission (for reportable incidents involving NDIS participants)
    • MedHireHub as soon as practicable after making the mandatory report
  • Report any incidents, accidents, or concerns promptly to both the client facility and MedHireHub
  • Comply with MedHireHub's social media and external conduct expectations, including not posting content that:
    • Identifies or reveals personal information about participants, residents, clients, or other workers without consent
    • Is defamatory, discriminatory, harassing, or bullying in nature
    • Could bring MedHireHub, a client facility, or the healthcare profession into disrepute
    This obligation applies even outside work hours and when posting anonymously or under an alias
  • Not solicit or accept direct employment from a client facility within the restricted period specified in their placement agreement (where applicable) without paying applicable transfer fees
  • Accurately record hours worked and submit timesheets in accordance with agreed procedures
  • Comply with all applicable laws, including workplace health and safety requirements
  • Understand that there is no guarantee of constant, ongoing, or minimum hours of work. Shift allocation is at MedHireHub's discretion based on client demand and operational requirements
  • Provide accurate bank account details through our Intuit QuickBooks integration for payroll processing, and promptly update these details if they change

4B. Sharing Personal Information with Client Facilities

When attending a shift at a client location, Workers may be required to share limited personal information with the client facility for verification, safety, and care coordination purposes. Workers must share only the information necessary for the shift and must protect their privacy.

4B.1 Information Workers Must Share

Workers must provide the following to client facilities:

  • Full name and photograph — for identification and verification that the correct Worker has arrived
  • Relevant qualifications and credential status — if requested by the client facility for compliance verification (for example, showing current AHPRA registration, NDIS Worker Screening clearance, or first aid certificate)
  • Emergency contact details — in case of an incident or emergency during the shift
  • MedHireHub contact details — so the client facility can contact MedHireHub if needed

4B.2 Information Workers Must NOT Share

Workers must not share the following with client facilities or any third party:

  • Bank account details or financial information
  • Tax File Number (TFN)
  • Home address or personal contact details not necessary for the shift
  • Superannuation fund details
  • Employment history, references, or referee contact details
  • Login credentials, passwords, or access to their MedHireHub Platform account
  • Any information about other workers, clients, or shifts not relevant to the current engagement

If a client facility requests information that is not listed in Section 4B.1, the Worker should politely decline and refer the request to MedHireHub. MedHireHub will assess whether the request is reasonable and necessary, and will provide the information directly to the client facility where appropriate.

4B.3 Worker Privacy Protection

Client facilities must not require Workers to provide information beyond what is reasonably necessary for shift verification, safety, and care delivery. Client facilities must not retain Worker personal information after the shift has ended, except where required by law (for example, for incident reporting or regulatory records).

Workers who believe their privacy has been breached by a client facility should report this to MedHireHub immediately.

5. Client Obligations

By using our Services, Clients agree to:

  • Provide a safe workplace at client locations that complies with all applicable workplace health and safety laws
  • Supervise Workers appropriately at the client location and ensure they work within their scope of practice and competence
  • Not engage Workers for duties outside those specified in the placement arrangement without agreement
  • Pay all applicable fees, charges, and Worker wages in accordance with agreed terms
  • Provide accurate and complete information about placement requirements, client location details, workplace conditions, and participant or resident needs
  • Notify MedHireHub of any concerns about a Worker's conduct, competence, or suitability
  • Not directly solicit or employ a Worker introduced by MedHireHub without paying applicable transfer or placement fees
  • Use Provider Portal access solely for managing care for your own clients, and not to access information about workers engaged by other providers
  • Maintain confidentiality of worker information accessed through the Provider Portal
  • Respect Worker privacy by requesting only the personal information reasonably necessary for shift verification, safety, and care delivery as outlined in Section 4B, and not retain Worker personal information beyond what is required by law
  • Comply with all applicable laws, including the Aged Care Act 1997, NDIS Act 2013, Fair Work Act 2009, and relevant award conditions
  • Maintain adequate insurance coverage for their operations and any workers engaged through their facility
  • Be solely responsible for their own NDIS provider registration, aged care accreditation, and compliance with NDIS Practice Standards, Aged Care Quality Standards, and all other regulatory requirements applicable to their operations. MedHireHub does not audit, verify, or guarantee client facility compliance with any regulatory standards

5A. Roster Allocation and Shift Completion

5A.1 Shift Allocation

MedHireHub allocates shifts to Workers through the Platform based on client demand, worker availability, qualifications, and operational requirements. Workers will be notified of available shifts and must accept or decline shifts within the timeframe specified on the Platform.

No guarantee of work: MedHireHub does not guarantee any minimum number of shifts, hours, or ongoing work to Workers. Shift allocation is entirely discretionary and dependent on client demand. Casual workers are not entitled to regular or systematic hours unless separately agreed in writing.

5A.2 Attendance and Completion

Workers who accept a shift must attend the designated client location at the agreed start time, complete the full shift duration, and record shift attendance and completion through the Platform. Failure to attend a confirmed shift without reasonable notice may result in exclusion from future shift allocations.

5A.3 Shift Notes

Workers may be required to record shift notes, care observations, or incident reports through the Platform during or after a shift. These notes must be accurate, professional, and comply with client policies and all applicable privacy laws. Shift notes may be visible to the client provider for whose clients the shift was performed.

5B. Provider Portal Access

Where authorised, Clients may access the Provider Portal to view rosters, shift attendance, and worker credential status for shifts relating to their own clients.

Provider Portal access is subject to the following conditions:

  • Clients may only access information about Workers allocated to their own client engagements
  • Clients must not access, attempt to access, or request information about Workers engaged by other providers
  • All information accessed through the Provider Portal must be treated as confidential and used solely for managing care for the Client's own clients
  • Clients must not download, screenshot, or retain worker information beyond what is necessary for their own client management
  • MedHireHub reserves the right to audit Provider Portal access and suspend access for misuse

4A. Credential Verification and Expiry

4A.1 Worker Responsibility

Workers are solely responsible for ensuring that all credentials, registrations, clearances, qualifications, and mandatory training remain current and valid at all times during their engagement with MedHireHub. This includes but is not limited to:

  • AHPRA registration (where applicable)
  • NDIS Worker Screening Check
  • Working with Children Check
  • National Police Check
  • Immunisation records (including COVID-19, influenza, hepatitis B)
  • Visa and work rights documentation
  • All mandatory training certifications
  • Professional indemnity and public liability insurance

Workers must monitor expiry dates proactively and renew credentials before they expire. MedHireHub may send reminders, but the absence of a reminder does not relieve the Worker of their responsibility.

4A.2 MedHireHub Verification

MedHireHub verifies worker credentials at onboarding and conducts periodic checks. However, MedHireHub does not guarantee continuous monitoring of every credential for every Worker. Workers with expired or invalid credentials will be immediately removed from shift allocations and may have their account suspended until valid credentials are provided.

4A.3 No Work With Expired Credentials

A Worker must not attend any shift if any required credential has expired or become invalid. If a Worker attends a shift with expired credentials, MedHireHub may:

  • Remove the Worker from the shift immediately
  • Withhold payment for that shift
  • Suspend or terminate the Worker's account
  • Notify the client facility of the breach

MedHireHub is not liable for any consequences arising from a Worker attending a shift with expired or invalid credentials.

5C. Shift Cancellation and No-Show Policy

5C.1 Worker Cancellations

Workers must notify MedHireHub as soon as possible if they are unable to attend a confirmed shift. Repeated cancellations, cancellations without adequate notice, or failure to attend a confirmed shift ("no-show") may result in:

  • Removal from future shift allocations for a specified period
  • Requirement to provide a medical certificate or reasonable explanation
  • Suspension or termination of the Worker's account

No-show policy: Failure to attend a confirmed shift without prior notice is treated as a serious breach of these Terms and may result in immediate suspension.

5C.2 Client Cancellations

Clients must notify MedHireHub as soon as possible if they need to cancel a booked shift. Cancellation fees may apply depending on the notice period provided:

  • More than 24 hours notice: No cancellation fee
  • Less than 24 hours notice: Client may be charged a cancellation fee equivalent to a portion of the shift cost, as agreed in the individual service agreement
  • Less than 4 hours notice or after the Worker has commenced travel: Client may be charged the full shift cost

5D. Platform Availability and Account Security

5D.1 Platform Availability

MedHireHub aims to maintain the availability of the Platform at all times. However, we do not guarantee uninterrupted, timely, secure, or error-free access. The Platform may be unavailable from time to time for maintenance, updates, or due to factors beyond our control. We are not liable for any loss or damage arising from Platform unavailability.

5D.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials (username and password). You must:

  • Use a strong, unique password and change it regularly
  • Not share your account credentials with any other person
  • Notify us immediately if you suspect unauthorised access to your account
  • Log out of your account at the end of each session, especially on shared or public devices

MedHireHub is not liable for any loss or damage arising from unauthorised access to your account caused by your failure to comply with these security obligations.

5D.3 Device and App Use

Workers who use the MedHireHub mobile application must ensure their device is secure, updated, and compatible with the application. Workers are responsible for their own mobile data costs and device charges.

5E. Casual Conversion

In accordance with the Fair Work Act 2009 (Cth), casual employees who have been employed by HYRE UP PTY LTD for 12 months and have worked a regular pattern of hours on an ongoing basis during the last 6 months may be eligible to request conversion to permanent employment (full-time or part-time).

Eligible casual employees may submit a written request for casual conversion. MedHireHub will respond within 21 days. Conversion may be refused only on reasonable grounds, such as:

  • Significant changes to the worker's hours or roster
  • The worker's hours no longer aligning with the available full-time or part-time positions
  • Other reasonable business grounds as permitted by the Fair Work Act

MedHireHub will provide eligible casual employees with information about their casual conversion rights in accordance with the applicable Modern Award.

6. Fees and Payment

6.1 Fees

MedHireHub charges fees for its staffing and recruitment services. Fees vary based on the type of placement (casual, temporary, contract, or permanent), the role, and the terms agreed with each Client. All fees are agreed in writing before placement commencement.

Typical fee structures may include:

  • Casual placements: Hourly or daily rates inclusive of worker wages, casual loading, superannuation, payroll tax, workers compensation, and agency margin
  • Permanent placements: One-time placement fee calculated as a percentage of the worker's annual salary
  • Transfer fees: Fee payable if a Client directly employs a Worker originally placed on a casual basis
  • Additional charges: May apply for urgent placements, after-hours requests, public holiday shifts, or specialised roles

6.2 Payment Terms

Clients must pay all invoices within the agreed timeframe (typically 14 or 30 days from invoice date). Late payments may incur interest and administrative fees as permitted by law.

6.3 Worker Payment — Casual Employees

Casual employees are paid wages in accordance with the applicable Modern Award (such as the Aged Care Award, Social, Community, Home Care and Disability Services Industry Award, or Nurses Award) and the Fair Work Act 2009 (Cth). Payment includes casual loading, and PAYG tax is withheld at the applicable rate.

How pay rates are set: MedHireHub determines the pay rate for each shift. The rate is based on the applicable Modern Award minimum wage, plus any applicable penalties, allowances, and casual loading. MedHireHub may adjust rates based on operational costs, business sustainability, market conditions, and the fees agreed with the Client. Workers are informed of the pay rate for each shift before accepting it, and by accepting a shift, the Worker agrees to work at that offered rate.

Important: Workers do not negotiate pay rates directly with Clients. The Client pays MedHireHub for staffing services, and MedHireHub pays the Worker. The pay rate offered to the Worker is determined by MedHireHub and may differ from the total fee charged to the Client, which covers not only the Worker's wages but also MedHireHub's operational costs, compliance costs, insurance, technology, administration, and business margin.

Payment is based on actual hours worked and verified shift completion, not assigned hours. If a Worker is assigned a shift of a certain duration but does not complete the full shift, or if the shift is shortened, the Worker will be paid only for the actual hours worked as verified through the Platform (for example, by shift check-in and check-out records, approved timesheets, and client confirmation). If a Worker is assigned a 2-hour shift but works only 1 hour, the Worker will be paid for 1 hour only, at MedHireHub's discretion based on verified records.

MedHireHub reserves the right to withhold or adjust payment where:

  • The Worker fails to complete the full shift without valid reason
  • The Worker arrives late or leaves early without authorisation
  • The Worker fails to record accurate shift times through the Platform
  • The client facility disputes the hours claimed
  • The Worker breaches these Terms or client facility policies during the shift

Casual employees provide bank account details and Tax File Numbers through our Intuit QuickBooks integration for direct deposit of wages. Employees are responsible for ensuring their bank account and tax file information is accurate and current. MedHireHub is not responsible for delays or errors caused by incorrect bank details.

Payment is typically processed within the pay cycle following shift completion and approval of timesheets. Employees are responsible for submitting accurate timesheets through the Platform in accordance with agreed procedures.

6.4 Worker Payment — Independent Contractors

Where a Worker is engaged as an independent contractor, the Worker must issue a valid tax invoice to MedHireHub for services rendered. Invoices must include the Worker's ABN (or a statement that the Worker is not registered for GST and the reason why) and comply with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Payment terms for contractors are as agreed in writing before engagement (typically 14 or 30 days from receipt of a valid tax invoice). Contractors are responsible for their own tax, GST, and superannuation obligations.

6A. Workers Compensation and Insurance

6A.1 Insurance Maintained by MedHireHub

MedHireHub maintains the following insurance coverage for our business operations:

  • Workers Compensation Insurance: For casual employees, as required by state and territory legislation
  • Public Liability Insurance: Covering MedHireHub's business activities
  • Professional Indemnity Insurance: Covering MedHireHub's staffing and recruitment services

Details of our insurance coverage are available upon written request.

6A.2 Casual Employees

Casual employees engaged by HYRE UP PTY LTD are covered by MedHireHub's workers compensation insurance in accordance with the Workplace Injury Management and Workers Compensation Act 1998 (NSW) (or equivalent legislation in other states and territories). In the event of a work-related injury, employees must report the injury to MedHireHub and the client facility as soon as practicable.

6A.3 Independent Contractors

Independent contractors are not covered by MedHireHub's workers compensation insurance. Contractors must maintain their own workers compensation and/or personal accident insurance and provide evidence of coverage upon request.

6A.4 Worker Insurance Obligations

All Workers (whether casual employees or contractors) must maintain adequate professional indemnity and public liability insurance for the healthcare services they provide, or must be covered under the client facility's insurance arrangements. MedHireHub may request evidence of insurance coverage at any time.

6A.5 Client Facility Insurance

Client facilities must maintain adequate public liability and professional indemnity insurance for their operations. While MedHireHub maintains its own insurances, Client facilities remain responsible for workplace safety and any incidents occurring at their premises.

Important: MedHireHub's insurance policies do not extend to cover clinical negligence, professional malpractice, or care outcomes arising from a Worker's actions during a placement. Workers are responsible for their own professional conduct and may be personally liable for negligence or misconduct claims unless covered by the client facility's insurance or their own professional indemnity insurance.

6B. Superannuation Guarantee

In accordance with the Superannuation Guarantee (Administration) Act 1992 (Cth), HYRE UP PTY LTD will make superannuation guarantee contributions for eligible casual employees into a complying superannuation fund.

Eligibility is determined by the Superannuation Guarantee legislation (for example, where a casual employee earns $450 or more in a calendar month before tax, or where otherwise required by law). Employees may nominate their preferred superannuation fund by completing a Standard Choice Form.

Independent contractors are responsible for their own superannuation arrangements and are not entitled to superannuation guarantee contributions from MedHireHub.

6C. GST

All fees charged by MedHireHub to Clients are GST inclusive unless otherwise agreed in writing. MedHireHub is registered for GST (ABN 78 685 669 210) and will provide valid tax invoices where required.

Where a Worker is engaged as an independent contractor and is registered for GST, the contractor must include GST in their tax invoices where applicable. MedHireHub will claim input tax credits in accordance with GST legislation.

7. Intellectual Property

All content on the MedHireHub Platform, including text, graphics, logos, images, software, and databases, is the property of HYRE UP PTY LTD or its licensors and is protected by Australian and international intellectual property laws.

Users may not reproduce, modify, distribute, or create derivative works from any content on the Platform without our prior written consent.

Workers retain ownership of their resumes and professional profiles but grant MedHireHub a licence to use this information for the purpose of facilitating placements.

8. Confidentiality

All Users agree to maintain the confidentiality of any confidential information obtained through the Platform or during placements, including:

  • Personal information of patients, residents, and clients
  • Business information and trade secrets of client facilities
  • Proprietary information belonging to MedHireHub
  • Any information marked as confidential or that should reasonably be understood as confidential

This obligation survives termination of the User's relationship with MedHireHub.

9. Limitation of Liability

To the maximum extent permitted by law, HYRE UP PTY LTD's liability for any loss, damage, or claim arising from or in connection with our Services is limited as follows:

  • MedHireHub is not liable for clinical decisions, care outcomes, or professional clinical judgments made by Workers during placements. Client facilities retain responsibility for clinical oversight, care planning, and resident or participant outcomes
  • MedHireHub is not liable for the workplace conditions, safety, or conduct of Client facilities
  • MedHireHub does not guarantee that a Worker will be suitable for a particular placement or that a placement will meet a Client's requirements
  • MedHireHub is not liable for any consequential loss, including but not limited to loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, or indirect, special, or consequential damages, whether arising under contract, tort (including negligence), equity, statute, or otherwise
  • MedHireHub's total liability for any claim (except where prohibited by law) will not exceed the total fees paid by the relevant party to MedHireHub in the 12 months preceding the claim

Employment liability: Where Workers are engaged as casual employees of HYRE UP PTY LTD, MedHireHub accepts liability as the employer for employment-related matters (such as wages, PAYG withholding, superannuation guarantee, and workers compensation) as required by law. However, MedHireHub is not liable for the clinical or professional performance of Workers during placements, which remains the responsibility of the Client facility that directs and supervises the work.

Fraud and unlawful conduct: Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any other liability that cannot be excluded or limited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Australian Consumer Law or any other applicable law.

10. Indemnity

Each User agrees to indemnify and hold harmless HYRE UP PTY LTD, its directors, employees, agents, and contractors from and against any claim, loss, damage, liability, cost, or expense arising from:

  • The User's breach of these Terms
  • The User's negligent or unlawful conduct
  • Any personal injury, property damage, or breach of confidentiality caused by the User
  • Any claim by a third party arising from the User's use of our Services

11. Termination

11.1 By MedHireHub

We may suspend or terminate a User's access to the Platform immediately if we reasonably believe the User has:

  • Breached these Terms
  • Provided false or misleading information
  • Engaged in conduct that is unlawful, unethical, or harmful to others
  • Failed to maintain required qualifications or clearances
  • Created a risk to the safety or wellbeing of patients, residents, or other workers

11.2 By User

Users may terminate their account at any time by contacting us. Termination does not relieve Users of obligations accrued prior to termination, including payment obligations and confidentiality obligations.

11.3 Effect of Termination

Upon termination, all licences and rights granted to the User will cease. We may retain certain information as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

12. Dispute Resolution

If a dispute arises between a User and MedHireHub, the parties agree to follow this process:

  1. Informal resolution: The complainant must first contact MedHireHub in writing, outlining the nature of the dispute and desired outcome
  2. Internal review: MedHireHub will respond within 14 days and attempt to resolve the dispute internally
  3. Mediation: If the dispute cannot be resolved informally, the parties agree to attempt mediation through a mutually agreed mediator before commencing litigation
  4. Litigation: If mediation fails, either party may commence proceedings in the courts of New South Wales

13. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.

14. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify the application of any provision of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other consumer protection legislation that cannot be excluded, restricted, or modified by agreement.

To the extent that our Services are subject to consumer guarantees under the Australian Consumer Law, our liability will be limited to the remedies available under that law.

15. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to our handling of personal information as described in the Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be effective immediately upon posting on the Platform. Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically. Material changes will be notified to registered Users via email or through the Platform.

These Terms and Conditions are provided as a general guide and do not constitute legal advice. While we have endeavoured to ensure these terms are consistent with the Australian Consumer Law, Fair Work Act 2009 (Cth), Privacy Act 1988 (Cth), and other applicable laws, laws and regulations may change. HYRE UP PTY LTD recommends seeking independent legal advice to ensure these terms meet your specific circumstances and comply with all applicable laws.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect.

20. Waiver

No waiver of any term or condition of these Terms will be effective unless in writing and signed by the party granting the waiver. A failure or delay by either party in exercising any right, power, or privilege under these Terms does not constitute a waiver of that right, power, or privilege.

21. Force Majeure

MedHireHub will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, strikes, lockouts, power failures, internet service provider failures, government restrictions, or changes in law.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other written agreement between you and MedHireHub, constitute the entire agreement between you and MedHireHub regarding the use of our Services and supersede all prior agreements, understandings, and negotiations.

23. Assignment

MedHireHub may assign or transfer our rights and obligations under these Terms without your consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
